Personal Data Protection Clarification Text and Explicit Consent Declaration

A2 Composite Technologies San. and Tic. A.S. (“Company”), as the “data controller” within the scope of the Personal Data Protection Law No. 6698 (“KVKK”); We have prepared this KVKK Clarification Text in order to inform you transparently about your personal data processed within the framework of our website, communication channels and commercial activities. This text; It covers the purposes for which your personal data is processed, the legal grounds on which it is based, to whom it can be transferred, storage periods and your rights under Article 11 of the KVKK.

1. Data Controller

2. Methods of Collecting Your Personal Data

Your personal data may be collected verbally, in writing or electronically through our website, contact forms, e-mail correspondence, telephone calls, social media channels, sales processes, offer and order flows, event/visit processes and similar channels by fully or partially automated methods or non-automated means provided that they are part of the data recording system.

Example data collection scenarios; (i) offer/contact form (ii) sending a request/offer by e-mail, (iii) requesting information by telephone, (iv) visiting product pages, (v) communicating within the scope of dealer/business partner processes.

3. Categories of Personal Data Processed

The categories of personal data that may be processed by our Company may vary according to the activity subject to processing. In general, the following categories can be processed:

  • Identity Data: Name, surname (e.g. in case of form filling).
  • Contact Data: Telephone number, e-mail address, address information (if necessary).
  • Customer Transaction Data: Request for quotation, product interest, order/delivery information, request/complaint records.
  • Marketing Data: Campaign/announcement preferences in case of explicit consent.
  • Process Security Data: IP address, log records, device/session information (within the scope of site security and technical obligations).
  • Audio/Visual Data: Camera recordings (if available) of visits and events, provided that clear information is provided.

In accordance with the principle of data minimisation, our company is based on purpose-related, limited and measured data processing.

4. Purposes of Processing Personal Data

Your personal data may be processed for the following purposes within the scope of the personal data processing conditions specified in Articles 5 and 6 of the KVKK:

  • Presenting our products and services, preparing offers and carrying out sales processes,
  • Execution of customer relationship management (CRM) processes, request/complaint management,
  • Carrying out communication activities and providing support,
  • Planning and execution of logistics and dispatch processes (if necessary),
  • Execution of finance and accounting processes, fulfilment of legal obligations,
  • Carrying out information security processes, ensuring website security,
  • Fulfilment of legal obligations towards authorised institutions and organisations,
  • Marketing, promotion, campaign and announcement processes in case of explicit consent.

5. Legal Grounds for Processing Personal Data

Your personal data can be processed based on the legal reasons listed in Article 5/2 of the KVKK and explicit consent. Our processing activities may be based on the following legal grounds in particular: (i) data processing is necessary for the establishment or performance of a contract, (ii) it is mandatory for the data controller to fulfil its legal obligation, (iii) data processing is mandatory for the establishment, exercise or protection of a right, (iv) data processing is mandatory for the legitimate interests of the data controller, provided that it does not harm the fundamental rights and freedoms of the data subject, (v) explicit consent (especially marketing activities and some types of cookies).

6. Transfer of Personal Data

Your personal data may be transferred to the following recipient groups by taking the necessary security measures in accordance with Articles 8 and 9 of the KVKK in order to fulfil the above-mentioned purposes:

  • Business Partners and Suppliers: Service providers such as hosting, e-mail service, CRM infrastructure, logistics/transportation service, software/digital agency,
  • Authorised Public Institutions and Organisations: Institutions authorised to request information in accordance with the legislation,
  • Parties to the Legal Process: Lawyers, auditors and consultants involved in the relevant processes (where necessary).

The transfer is limited by the principles of fitness for purpose and data minimisation.

7. Transfer of Personal Data Abroad

Our Company may transfer your personal data abroad in cases such as the infrastructure providers used abroad or technical obligations, within the framework of the conditions stipulated in the KVKK and the relevant legislation and by taking the necessary security measures. In cases where the transfer abroad is subject to explicit consent, explicit consent is obtained from the person concerned.

8. Retention Periods of Personal Data

Your personal data are stored for the period required by the purposes of processing and for the statute of limitations/retention periods stipulated in the relevant legislation. When the purpose of processing disappears and there is no legal retention obligation, the data is deleted, destroyed or anonymised in accordance with Article 7 of the KVKK.

9. Processing of Special Categories of Personal Data

Within the scope of KVKK, data such as health information, biometric and genetic data are considered as “special categories of personal data”. Our Company processes special categories of personal data only with the explicit consent of the data subject and if the purpose of processing is mandatory, by taking adequate measures stipulated by the Board.

10. Your Rights under Article 11 of the LPPD

Pursuant to Article 11 of the LPPD as data subjects pursuant to Art; (i) to learn whether your personal data has been processed, (ii) to request information if it has been processed, (iii) to learn the purpose of processing and whether it is used in accordance with its purpose, (iv) to know the third parties to whom it has been transferred domestically or abroad, (v) to request correction if incomplete / incorrectly processed, (vi) to request deletion/destruction or anonymisation, (vii) to request notification of the transferred third parties, (viii) to object to the occurrence of an unfavourable result as a result of analysis by automated systems, (ix) you have the right to demand the compensation of the damage in case you suffer damage due to unlawful processing.

11. Application and Contact

Pursuant to Article 13 of the LPPD, you may submit your applications to our Company in writing or by the methods stipulated in the legislation.
